Terms of Service: Kiwiform

Welcome to Kiwiform. These Terms of Service (“Terms”) are a legal agreement between you and Mythics Design LLP, a limited liability partnership registered in India (the “Company,” “we,” “us,” or “our”), governing your use of the Kiwiform.com website and services.

  1. Acceptance of Terms


    By creating an account, accessing, or using Kiwiform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our services.



  2. The Service

    Kiwiform provides a platform for building, hosting, and analyzing digital forms.

    • Mythics Design LLP provides the software and infrastructure.

    • Polar.sh acts as our global Merchant of Record for all billing and subscription management.


  3. Subscriptions, Payments & Taxes (via Polar.sh)

    All financial transactions are processed by Polar.sh.

    • Contract of Sale: When you upgrade to a paid plan, your legal contract for the purchase is with Polar.sh. They are responsible for global tax (GST/VAT/Sales Tax) compliance and payment security.

    • Service Delivery: Mythics Design LLP remains responsible for the delivery and maintenance of the Kiwiform software.

    • Refunds: Requests for refunds are governed by our refund policy and processed through the Polar.sh platform. Contact [email protected] for assistance.


  4. User Content & Conduct

    You retain all ownership rights to the content you create and the data you collect. However, you agree not to use Kiwiform for:

    • Illegal Activities: Phishing, fraud, or the unauthorized collection of sensitive personal identifiers (e.g., Aadhar numbers, passwords, or credit card info).

    • Spam: Sending unsolicited messages or using forms to harvest data for spamming.

    • Partial Submissions: You acknowledge that Kiwiform captures data in real-time. You are solely responsible for ensuring that your forms include a privacy notice informing your respondents that their data is saved as they type.


  5. Intellectual Property

    The Kiwiform brand, logo, code, and design are the exclusive property of Mythics Design LLP. You are granted a limited, non-exclusive, non-transferable license to use the service for its intended purpose.


  6. AI Translation & Limitations

    Our translation features utilize the OpenAI API.

    • Liability: While we strive for accuracy, Mythics Design LLP is not responsible for any mistranslations or cultural inaccuracies generated by the AI.

    • Usage: You agree not to use the translation feature in a way that violates OpenAI’s usage policies.



  7. Limitation of Liability

    To the maximum extent permitted by Indian law, Mythics Design LLP shall not be liable for any indirect, incidental, or consequential damages. Our total liability for any claim arising out of these terms shall not exceed the total amount paid by you to us (via Polar.sh) in the twelve (12) months preceding the claim.


  8. Governing Law & Jurisdiction

    These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in [Insert City, e.g., Mumbai/Bangalore/Delhi], India.


  9. Termination

    We reserve the right to suspend or terminate accounts that violate these Terms or threaten the security of our platform. You may terminate your account at any time by deleting it through your dashboard.
